New cable distribution undertakings
Following a Public Hearing held in the National Capital Region on 21 February 1995, the Commission approves the applications by 2871483 Canada Inc. for licences to carry on cable distribution undertakings to serve Saint-Michel (Napierville) and Saint-Paul-de-l'Île-aux-Noix, and will issue Class 2 (fewer than 2,000 subscribers) licences expiring 31 August 1998. This term is consistent with the Commission's practice regarding the licensing of new undertakings of this type.
With the exception of the requirements stipulated in section 23 of the Cable Television Regulations, 1986, the operation of these undertakings will be regulated pursuant to Parts I and III of the regulations and the licences will be subject to the conditions specified in this decision and in the licences to be issued.
Although the Commission does not regulate the rates of Class 2 undertakings with fewer than 2,000 subscribers, it notes that the applicant has proposed a monthly subscriber fee of $24.15 for Saint-Michel (Napierville) and $21.76 for Saint-Paul-de-l'Île-aux-Noix.
In accordance with subsection 22(1) of the Broadcasting Act, the Commission will issue licences to the applicant if it is in receipt of a written notification from the Department of Industry, Science and Technology (DIST), within twelve months of the date of this decision that it will issue Broadcasting Certificates. No licence will be issued if the Commission does not receive this notification within said period or, where the applicant applies to the Commission within this period and satisfies the Commission that it is unable to obtain said notification before the expiry of this period and that an extension is in the public interest, within such further periods of time as are approved in writing by the Commission.
It is a condition of each licence that the authority granted herein be implemented within twelve months of the date of receipt of the DIST notification referred to in the preceding paragraph or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot implement its authority before the expiry of this period and that an extension is in the public interest, within such further periods of time as are approved in writing by the Commission.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the applicant to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
