Licence renewal and amendment
Following Public Notice CRTC 1994-159 dated 23 December 1994, the Commission renews the licence held by Peachland Cable Ltd., for the cable distribution undertaking serving Peachland, from 1 September 1995 to 31 August 2001.
The licence term granted herein, while less than the maximum of seven years permitted by the Broadcasting Act, will enable the Commission to consider the next licence renewal of this undertaking in accordance with the Commission's regional plan and to better distribute the workload within the Commission. This term is not reflective of any Commission concern regarding the licensee's performance.
The operation of this undertaking is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in the licence to be issued.
As part of the renewal application, the licensee proposed to distribute CBMT Montréal, a CBC affiliate. An intervention to this part of the application was submitted by Okanagan Valley Television, licensee of CHBC-TV Kelowna, a station affiliated to the CBC. Okanagan Valley Television argued that the carriage of CBMT would be contrary to the CBC's own "Guidelines for the Distribution of CBC Satellite Delivered Television Services". In this regard, the Commission notes correspondence from the Canadian Broadcasting Corporation to the licensee indicating that it is not prepared to grant permission for the distribution of CBMT Montréal, received via satellite. Under the terms of the "List of Part III Eligible Satellite Services" (appendix to Public Notice CRTC 1995-8), carriage of the CBC English- and French-language satellite television services is authorized only if the licensee has entered into the necessary contractual arrangements with the CBC. Accordingly, in the absence of such arrangements, the Commission denies the licensee's proposal to distribute CBMT Montréal.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
