IN THE MATTER OF AGT Limited (AGT) Phase III Manual update submitted 10 July 1995.
WHEREAS in AGT Limited - Phase III Manual: Compliance with Public Notice 94-41 and Order 93-20, Telecom Decision CRTC 95-9, 26 May 1995 (Decision 95-9), the Commission approved AGT's Phase III Manual, subject to the resolution of items identified in the Appendix to the Decision and required updates and reports;
WHEREAS, on 10 July 1995, AGT submitted the explanations, updates and reports required by Decision 95-9;
WHEREAS, on 2 August 1995, Unitel Communications Inc. (Unitel) filed comments with respect to AGT's re-assignment of certain maintenance expenses from the CN category to the Access category and AGT's treatment of credit and collection expenses in its Phase III Manual;
WHEREAS Unitel objected to AGT's methodology enhancements noting that it would result in a shift of over 9% of AGT's forecasted 1994 operating expenses to the Access category;
WHEREAS Unitel commented that AGT's update failed to incorporate the Commission's objectives to change the basis of assignment of credit and collection expenses to composite revenue ratios;
WHEREAS AGT noted that the re-assignment of its maintenance test function expense for CN service access loops is appropriate and that this proposal is an improvement to its Phase III processes;
WHEREAS AGT, in its reply, submitted revised pages assigning collection expenses using composite revenue ratios but excluded credit verification expense;
WHEREAS AGT replied that the directives in Decision 95-9 regarding collection expenses and CMR equivalent expenses do not address the treatment of credit verification expenses;
WHEREAS the Commission notes that Unitel did not specifically address the appropriateness of the maintenance methodology change;
WHEREAS the Commission considers AGT's proposed maintenance re-assignment to be reasonable and that it will result in an improvement to the assignment methodology used in the Maintenance Expense study;
WHEREAS the Commission notes that credit verification expense was not addressed in Decision 95-9 and considers AGT's treatment of this expense to be appropriate;
WHEREAS the Commission considers reports filed by AGT in compliance with Decision 95-9 to be acceptable;
WHEREAS the Commission's review of AGT's update report has revealed an inappropriate tariff classification for Financing Terms (CTT2190);
WHEREAS the Commission considers the revised classifications and explanations provided for the items identified in the Appendix to Decision 95-9 to be appropriate, with the exception of the tariff classification for Emergency Reporting System (GT 240); and
WHEREAS AGT must file amended pages to its Phase III Manual in accordance with the Commission's findings set out in this Order -
IT IS HEREBY ORDERED THAT:
1. The company is directed to assign its Emergency Reporting System (GT240) service to the ML category only.
2. The company is directed to assign its revenue for Financing Terms (CTT2190) to the CTMD and CTO categories.
3. The modification to BSCC 75.640.03 Marketing Expense and BSCC 75.660.02 Regulatory & Intercarrier Expense as submitted 10 July 1995 and the modification to BSCC 75.640.05 Billing & Collection Expense as submitted 16 August 1995, as directed in Decision 95-9, are approved.
4. Subject to item 2 above, the updates reflecting revisions to the company's tariffs, accounts and procedures relevant to the production of 1994 results are approved.
5. The procedures amended to comply with the directions and determinations in Telecom Decision 94-24 that apply to the company are approved.
6. Subject to item 1 above, the explanations required by the Appendix to Decision 95-9 are accepted.
7. The conditions to the approval of the company's Phase III Manual stipulated in Decision 95-9 are removed.
8. Amended Phase III Manual pages, reflecting all updates approved in this order that are relevant to the production of AGT's 1994 Phase III results, are to be filed by 30 September 1995.
