TO ALL LICENSEES OF DISTRIBUTION UNDERTAKINGS

Change to Licensing Procedures for Applications to Extend Authorized Service Areas

The purpose of this circular is to advise licensees of broadcasting distribution undertakings of a change to the licensing procedures concerning applications to extend authorized service areas.
Until now, the Commission's practice has been to approve administratively applications to extend authorized service areas of existing (cable) distribution undertakings, in cases where there were no existing distribution undertakings licensed nearby and there was no concern with the application. In cases where there was a distribution undertaking licensed nearby the proposed area, the Commission's practice has been to issue a public notice to deal with such applications.
In light of the evolving competitive environment, the Commission has simplified its licensing procedures to expedite the processing of routine applications by cable distribution undertakings for extensions to their authorized service areas. Specifically, the Commission intends to process all such applications administratively, without the issuance of a public notice or notice of public hearing, provided that the proposed service area does not include, in whole or in part, any area already licensed to another cable distribution undertaking. When such applications are approved, the Commission will provide any cable distribution undertaking serving nearby areas with a copy of the service area map showing the approved extension, for information purposes.
The Commission will process applications by cable distribution undertakings for service area extension by public notice or by notice of public hearing, in cases where the proposed service area includes any part of the licensed area of another cable distribution undertaking.
