Acquisition of assets
Following a Public Hearing in the National Capital Region held on 5 June 1996, the Commission approves the application for authority to acquire the assets of the cable distribution undertaking serving Kirkland Lake and Swastika, from Fred Lang T.V. Limited, and for a broadcasting licence to continue the operation of this undertaking.
The Commission notes that this transaction represents a corporate reorganization that does not alter the ultimate effective control of the licensee.
The Commission will issue a licence to 1142370 Ontario Inc., expiring 31 August 2000, the current expiry date, upon surrender of the current licence. The operation of this undertaking will be regulated pursuant to Parts I, II and IV of the Cable Television Regulations, 1986 (the regulations). The authority granted herein is subject to the same conditions as those in effect under the current licence, as well as to any other condition specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute, at its option, WGRZ-TV (NBC), WIVB-TV (CBS) Buffalo and WOKR-TV (ABC) Rochester, New York, received via microwave, as part of the basic service.
The licensee is also authorized to continue to distribute, at its option, CIII-TV, received via satellite, as part of the basic service.
Consistent with Decision CRTC 93-251 dated 8 July 1993, the licensee is relieved, by condition of licence, of the requirement of section 12 of the regulations to distribute the signals of CFCL-TV-2 and CITO-TV-2 Kearns, on unrestricted channels. Should the quality of either signal deteriorate significantly, the Commission expects the licensee to undertake immediate corrective action including, if necessary, the distribution of the services on other channels.
This decision is to be appended to the licence.
