Decision

Ottawa, 8 November 1996
Decision CRTC 96-742
Télé-Câble Charlevoix (1977) inc.
Saint-Édouard-de-Lotbinière, Quebec - 199607214
Licence amendments
Following Public Notice CRTC 1996-124 dated 4 September 1996, the Commission approves the application to change the licensed area for the cable distribution undertaking serving Saint-Édouard-de-Lotbinière, by excluding areas located southwest and northeast of Saint-Édouard-de-Lotbinière, along Highway 226, as well as small areas located northeast and northwest of Saint-Édouard-de-Lotbinière, along Concession Road St-Charles, representing a total of 45 households.
The Commission notes that the licensee no longer intends to implement the interconnection of its undertaking to Vidéotron ltée's Intervision (Québec) inc. network, as approved in Decision CRTC 94-782 dated 29 September 1994. The Commission, therefore, approves the licensee's request to delete the condition of licence and authority which were granted in the context of the proposed interconnection.
Accordingly, the Commission deletes the authority to distribute CFCF-TV and CFTU-TV Montréal, WVNY (ABC) and WCAX-TV (CBS) Burlington, Vermont as well as WPTZ (NBC) and WCFE-TV (PBS) Plattsburgh, New York, received via microwave at the Lotbinière distant head end, as part of the basic service. The Commission notes that the licensee will distribute instead CFJP-TV (TQS) Montréal and CITV-TV (IND) Edmonton, as well as WTOL-TV (CBS) Toledo, Ohio, WDIV (NBC), WXYZ-TV (ABC) and WTVS (PBS) Detroit, Michigan, received via satellite from CANCOM.
The Commission also deletes the condition of licence relieving the licensee from the requirement of subsection 22(1) of the Cable Television Regulations, 1986 (the regulations) that it distribute the local signal of CKTM-TV (CBC) Trois-Rivières on the basic band. The Commission notes that the licensee will distribute this signal on the basic band.
In addition, the Commission approves the licensee's request to be relieved, by condition of licence, from the requirement of paragraph 22(1)(b) of the regulations that it distribute the priority regional service of CFAP-TV (TQS) Québec, on the basic band. The licensee will distribute instead the signal of CFJP-TV (TQS) Montréal, received via satellite, on the basic band.
This decision is to be appended to the licence.
