Licence renewal
Following Public Notice CRTC 1996-144 dated 4 November 1996 and Decision CRTC 96-588 dated 30 August 1996, the Commission renews the Class 2 (fewer than 2,000 subscribers) licences held by Valley Cable Vision Limited, for the cable distribution undertakings serving the above-noted localities, from 1 January 1997 to 31 August 2003.
With the exception of the requirements stipulated in section 23 of the Cable Television Regulations, 1986 (the regulations), the operation of these undertakings is regulated pursuant to Parts I, III and IV of the regulations and the licences will be subject to the conditions in effect under the current licences as well as to those conditions specified in this decision and in the licences to be issued.
Altona, Carman, Morden, Steinbach and Winkler
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute, at its option, KGFE-TV (PBS) Grand Forks, received via microwave, as part of the basic service.
It is a condition of each licence that the system share in the joint use of a distant head end located at Tolstoi, Manitoba.
Lorette, Notre-Dame-de-Lourdes, St-Claude, St-Pierre Jolys, and Ste-Anne
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, CFTM-TV (TVA) Montréal, received via satellite from CANCOM, as part of the basic service.
Miami
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to distribute, at its option, the programming service of WXYZ-TV (ABC) Detroit, a duplicate ABC signal, received via satellite from CANCOM, as part of the basic service.
In approving the licensee's request to be exempt from its policy regarding the carriage of duplicate signals, the Commission has taken into consideration the fact that this service was added to the undertaking prior to the issuance of Public Notice CRTC 1995-8 dated 19 January 1995 which restricted the carriage of duplicate commercial U.S. network affiliates received via satellite.
In addition, the licensee indicated that the distribution of the Detroit signal received via CANCOM was necessary because of the unreliability of the North Dakota signal which is received over the air. Given the subscriber preference for the North Dakota signal due to the station's proximity to Miami, the Commission notes the licensee's intention to return to a single source once reliability issues have been resolved.
Other matters
It is a condition of each licence that, for community programming and any other programming of a service that it originates, the licensee adhere to the guidelines on the depiction of violence in television programming set out in the CAB's "Voluntary Code Regarding Violence in Television Programming", as amended from time to time and approved by the Commission.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
This decision is to be appended to the licence.
