Licence amendment for CKTB
Following Public Notice CRTC 1995-178 dated 18 October 1995, the Commission approves the application to amend the broadcasting licence for the radio programming undertaking CKTB St. Catharines by adding the following condition of licence consistent with Public Notice CRTC 1993-5 dated 29 January 1993 entitled "Changes to the Content Requirements for Canadian Music on Radio":
    in those periods of category 2 music consisting exclusively of music composed before 1956, the Canadian content level shall not be less than 2% on a weekly basis;
    in those periods of category 2 music consisting of 90% or more, but not exclusively of music composed before 1956, the Canadian content level shall be not less than 10% on a weekly basis.
In this regard, the Commission notes that it will be the licensee's responsibility to ascertain the date of composition of the selections it broadcasts and that it must also identify periods of pre-1956 station-originated programming whenever requested by the Commission to submit information concerning the station's broadcasting of Canadian music.
The Commission notes that this application is in conformity with its policy and that approval will have no impact on other broadcasters.
Prior to submission of this application, and as part of its ongoing monitoring of all radio licensees, the Commission conducted an analysis of the Canadian content broadcast on CKTB during the week of 23 to 29 April 1995. As a result of this analysis, the licensee was found to be in non-compliance with the regulatory requirements for the broadcast of Canadian music in both categories 2 and 3.
The Commission notes that the licensee submitted a self-assessment report confirming that CKTB was in non-compliance with regard to the minimum requirements for Canadian content in categories 2 and 3 for the week of 23 to 29 April 1995.
The Commission will revisit the matter of the licensee's apparent non-compliance with respect to Canadian content at the time of the next licence renewal.
This decision is to be appended to the licence.
