Telecom Public Notice

Ottawa, 6 June 1996
Telecom Public Notice CRTC 96-23
NORTHWESTEL INC. - FORBEARANCE FROM REGULATION OF PACKET DATA SERVICES
I. BACKGROUND
On 1 May 1996, Northwestel Inc. (Northwestel) filed an application pursuant to section 34 of the Telecommunications Act (the Act), requesting forbearance from the regulation of Northwestel's Datapac, future X.25, packet data and frame relay services. In particular, Northwestel requested that the Commission refrain from exercising all powers and performing all duties under sections 25, 29 and 31, and subsections 27(1), 27(5) and 27(6) of the Act.
The Commission seeks comment regarding the appropriateness of forbearing pursuant to section 34 of the Act. The Commission notes that, in Review of Regulatory Framework, Telecom Decision CRTC 94-19, 16 September 1994, it detailed the factors that it will consider when assessing whether a particular market is or will be sufficiently competitive for the Commission to refrain from regulation. Parties are expected to address these factors in their submissions.
 II PROCEDURE
 1. The application may be examined at any of Northwestel's business offices or at the offices of the CRTC, Central Building, Les Terrasses de la Chaudière, 1 Promenade du Portage, Room 201, Hull, Quebec, or 800 Burrard Street, Suite 1380, Vancouver, British Columbia. A copy of Northwestel's application may be obtained by any interested person upon request directed to the company at the address shown below.

Bag 790, 5201 - 50th Avenue, Northwest Tower, 11th Floor, Yellowknife, NWT, X1A 2N6, fax: (403) 669-7301.
 3. Northwestel may file a reply to any comments, serving copies on interveners by 30 July 1996.
