Decision

Ottawa, 9 April 1997
Decision CRTC 97-125
Burlington Broadcasting Inc.
Burlington, Ontario - 199607826
Decrease in power for CING-FM
Following Public Notice CRTC 1997-1 dated 7 January 1997, the Commission approves the application to amend the broadcasting licence for CING-FM Burlington, by decreasing the effective radiated power from 50,000 watts to 26,100 watts.
The licensee also proposes to relocate the CING-FM transmitting facilities to a new site approximately 8 kilometres northwest of Burlington and to increase the effective height of the antenna. The Commission notes that, as a result, there will be no significant change in the service contours, as presently authorized.
The Commission hereby authorizes the licensee to operate the undertaking on the basis of the contours and particulars resulting from the above-mentioned changes.
The Department of Industry has advised the Commission that this application is conditionally technically acceptable, and that a Broadcasting Certificate will only be issued once it has been determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.
In accordance with subsection 22(1) of the Broadcasting Act, the Commission will only issue the licence amendment, and the authority will only be granted, at such time as written notification is received from the Department of Industry that its technical requirements have been met, and that a Broadcasting Certificate will be issued.
The Commission acknowledges the interventions received opposing this application and is satisfied with the licensee's replies thereto. The Commission also acknowledges an intervention received in support of the application.
This decision is to be appended to the licence.
Allan J. Darling
Secretary General
