Telecom Order CRTC 97-267
IN THE MATTER OF applications from resellers of Centrex III Service, namely, Hamilton Telecom and New Wave Tele-Communications Ltd., requesting exemptions from the contribution charges specified in Competition in the Provision of Public Long Distance Voice Telephone Services and Related Resale and Sharing Issues, Telecom Decision CRTC 92-12, 12 June 1992 (Decision 92-12).

WHEREAS the Commission notes that Bell Canada (Bell) considers that these applications are acceptable;
WHEREAS the Commission is of the view that the following applications meet its evidentiary requirements as set out in Decision 92-12 and Applications for Contribution Exemptions, Telecom Decision CRTC 93-2, 1 April 1993;
1. WHEREAS the Commission notes that Bell, in its letter of 22 January 1997 with respect to Hamilton Telecom, argued that the effective date of the application should be 30 December 1996 (the date of the affidavit) rather than 19 December 1996 (the date of the application);
1. WHEREAS in Effective Date of Contribution Exemptions, Telecom Public Notice CRTC 95-26, 12 June 1995 (PN 95-26), the Commission stated that contribution exemptions will generally be granted effective the later of the date of application or the date of installation, absent special circumstances;
1. WHEREAS, generally, after reviewing situations on a case-by-case basis where an application includes an affidavit with a date different than the application, the Commission has accepted the earlier of the two dates as the effective date, as long as there is no substantial difference between the dates; and
1. WHEREAS in the Hamilton Telecom case, the Commission is of the view that granting the exemption effective 19 December 1996 would be appropriate and in accordance with past practice -
IT IS HEREBY ORDERED THAT:
1. Hamilton Telecom's application dated 19 December 1996 for single-hop circuits is approved effective the date of the application.
2. New Wave Tele-Communications Ltd.'s application dated 19 December 1996 for single-hop circuits is approved effective the date of the application (based on carrier verification for the usage and separation of single-hop and double-hop services).
