Telecom Order CRTC 97-738
On 6 May 1997, Bell Canada (Bell) filed an application for approval of revisions to its General Tariff Item 2165, providing for a promotion applicable to Bell's Calling Features for a period of up to 8 weeks, effective 5 June 1997.

1. Under the proposal, an introductory promotional offer consisting of one of the following four options would be made available to eligible customers, defined as customers in designated exchanges who are not subscribing to the available Calling Features at the start of the promotion period:
(i) waiver of the monthly rate in the first month of subscription (31 days);
(ii) waiver of the monthly rate in the first two months of subscription (62 days);
(iii) monthly subscription of features for $1.00 for 31 days; or
(iv) monthly subscription of features at 50% off the regular monthly rate for 62 days.
2. Customers wishing to participate would be required to place an order with the Company to receive the promotional offer.
3. The Commission considers that it is unclear based upon the wording of the proposed tariff whether Bell or the customer would determine which of the four promotional options would be applicable to any given customer.
4. The Commission notes in any event that the proposed tariff would, in addition, give Bell considerable discretion as to the circumstances under which different rates would apply.
5. In the circumstances, the Commission considers the proposed tariff to be potentially unjustly discriminatory and, therefore likely to be contrary to subsection 27(2) of the Telecommunications Act.
6. In light of the foregoing, the Commission orders that:
The proposed tariff revisions are denied.
