Amendments to the Cable Television Regulations, 1986
1. In Public Notices CRTC 1997-16 and CRTC 1997-26 dated 19 February and 11 March 1997 respectively, the Commission announced proposals to amend the Cable Television Regulations, 1986 (the Regulations). A copy of the proposed amendments were annexed to the notices for public comment.
2. The amendment proposed in Public Notice CRTC 1997-16 changes the Public Notice referred to in subsection 10(2) of the Regulations in order to establish new distribution and linkage requirements for programming services.
3. The amendment proposed in Public Notice CRTC 1997-26 repeals subsections 18(5) to (7) of the Regulations, such that capital expenditures incurred by a licensee after 31 August 1996 will not be recoverable through an increase in the licensee's basic monthly fee. Any increase previously taken pursuant to subsection 18(6) effectively will be embedded in the basic monthly fee on an on-going basis.
4. The Commission received one submission on the first proposed amendment and two on the second.
5. Having considered all of the submissions, the Commission announces that it has adopted the amendments as proposed. A copy of the amending regulations is appended to this notice. These statutory instruments were registered on 12 May 1997 and the regulations amending subsection 10(2) came into force on that day. The regulations repealing subsections 18(5) to (7) will come into force on 31 December 1997. These instruments were published in the Canada Gazette Part II on 28 May 1997 (SOR/97-259 and SOR/97-260).

Whereas, pursuant to subsection 10(3) of the Broadcasting Acta, a copy of the proposed Regulations Amending the Cable Television Regulations, 1986, substantially in the annexed form, was published in the Canada Gazette, Part I, on March 1, 1997, and a reasonable opportunity was thereby given to licensees and other interested persons to make representations to the Canadian Radio-television and Telecommunications Commission with respect thereto;
Therefore, the Canadian Radio-television and Telecommunications Commission, pursuant to subsection 10(1) of the Broadcasting Acta, hereby makes the annexed Regulations Amending the Cable Television Regulations, 1986.

REGULATIONS AMENDING THE CABLE TELEVISION REGULATIONS, 1986
AMENDMENT
1. Subsection 10(2)3 of the Cable Television Regulations, 19864 is replaced by the following:
(2) Except as otherwise provided pursuant to a condition of its licence, where a licensee distributes a programming service referred to in paragraph (1)(e), (f) or (h), the licensee shall distribute the service in accordance with the rules governing the distribution of the service as set out in Public Notice CRTC 1996-121, entitled Distribution and Linkage Requirements.
