Licence amendment for Outdoor Life

1. Following Public Notice CRTC 1998-10 dated 10 February 1998, the Commission approves the application by 1163031 Ontario Inc. to amend condition of licence no. 2 relating to the broadcast of Canadian programs as follows:

2. The licensee shall devote to the distribution of Canadian programs not less than 30% of the broadcast day averaged over the broadcast year, and not less than 30% of the evening broadcast period.

2. The licensee indicated that the purpose of the application is to obtain the same flexibility as that given to the licensees of most of the specialty services authorized in 1996, specifically to average the broadcast of Canadian programs over the broadcast year.

3. The Commission also approves the licensee's application to amend condition of licence no. 4 by increasing from 8 to 12 minutes the advertising material allowed during each clock hour. Consequently, the amended condition of licence reads as follows:

4.(a) Subject to subsections (b), (d) and (e), the licensee shall not distribute more than twelve (12) minutes of advertising material during each clock hour.

4.(b) In addition to the twelve minutes of advertising material referred to in subsection (a), the licensee may distribute during each clock hour, a maximum of 30 seconds of additional advertising material that consists of unpaid public service announcements.

4.(c) The licensee shall not distribute any paid advertising material other than national paid advertising.

4.(d) Where a program occupies time in two or more consecutive clock hours, the licensee may exceed the maximum number of minutes of advertising material allowed in those clock hours if the average number of minutes of advertising material in the clock hours occupied by the program does not exceed the maximum number of minutes that would otherwise be allowed per clock hour.

4.(e) In addition to the twelve minutes of advertising material referred to in subsection 4(a), the licensee may broadcast partisan political advertising during an election period.

4. The Commission notes that this amended condition of licence is also consistent with the condition of licence concerning advertising which has been imposed on several other specialty programming undertakings.

5. The Commission acknowledges the intervention received with respect to this aplication as well as the licensee's reply thereto.

This decision is to be appended to the licence.
