Deletion of conditions of licence
1. Following Public Notice CRTC 1998-56 dated 3 June 1998, the Commission approves the applications by Regional Cablesystems Inc. to amend the broadcasting licences of its cable distribution undertakings serving the above-mentioned localities, as outlined below.
Sydenham, Newburgh, Verona and Tamworth
2. The Commission deletes the condition of licence authorizing the distribution, at the licensee's option, of WXYZ-TV (ABC) Detroit, Michigan, received via satellite from Cancom, as part of the basic service. The Commission authorizes the licensee to distribute, at its option, WWTI (ABC) Watertown, New York as part of the basic service. The licensee intends to receive WWTI over the air.
3. WWTI commenced operation after 1 January 1985. In Public Notice CRTC 1993-74 dated 3 June 1993, the Commission stated that applications for the distribution, as part of the basic service, of post-1985 independent stations received directly over the air at the local head end of an undertaking would only be approved if the Commission determines that the U.S. station does not materially compete for Canadian advertising dollars.
4. The Commission is satisfied that WWTI is predominantly directed to a U.S. market and will not materially compete with Canadian stations for advertising dollars or otherwise affect existing broadcasters in the area.
Newburgh and Tamworth
5. The Commission deletes the condition of licence authorizing the distribution, at the licensee's option, of WTVS-TV (PBS) Detroit, Michigan received via satellite from Cancom, as part of the basic service. The Commission notes that the licensee will distribute WNPE (PBS) Watertown, New York, received over the air, as part of the basic service.
6. With respect to all undertakings noted above, the licensee may receive any authorized signals over the air, or from any licensed or exempted Canadian broadcasting distribution undertaking authorized to provide signals to other broadcasting distribution undertakings.
7. The Commission notes that the licensee plans to delete the local head ends of the cable distribution undertakings serving Newburgh, Verona and Tamworth, and to interconnect these undertakings with the Sydenham undertaking.
This decision is to be appended to each licence.
