Decision

Ottawa, 22 September 1998
Decision CRTC 98-443
Fundy Cable Ltd./Ltée
Ludford Subdivision and Noonan, New Brunswick - 199802856 - 199802898
Deletion of local head ends and signal distribution changes
1. Following Public Notice CRTC 1998-69 dated 16 July 1998, the Commission approves the applications to amend the broadcasting licences for the cable distribution undertakings serving Ludford Subdivision and Noonan. The licensee is relieved, by condition of licence, from the requirement of section 32(1)(a) of the Broadcasting Distribution Regulations to distribute the local priority signal of CIHF-TV-1 (IND) Fredericton. The licensee will distribute instead CIHF-TV-2 Saint John, received via optical fibre from its Fredericton undertaking.
2. The Commission notes that the licensee proposes to delete the local head ends of these undertakings and to interconnect them, by optical fibre, to the cable distribution undertaking serving Fredericton, also owned by the licensee.
3. The Commission authorizes the licensee to distribute, at its option, the programming service of distant Canadian station CFTF-TV-1 (TQS) Edmundston, as well as WMEM-TV (PBS) Presque Isle and WLBZ-TV (NBC) Bangor, Maine, as part of the basic service. The Commission notes that the licensee will receive these signals by optical fibre from its Fredericton undertaking.
4. The licensee may receive any authorized signals over the air, or from any licensed or exempted Canadian broadcasting distribution undertaking authorized to provide signals to other broadcasting distribution undertakings.
This decision is to be appended to each licence.
