The Commision has received an ex parte application from MTS Communications Inc. under Tariff Notice 323 dated 22 April 1998, for the introduction of FLEX Access, a service which provides digital access to network services from the customer's premise. The company proposed, among other things, to classify the FLEX Access service as an uncapped service.

1. In Price Cap Regulation and Related Issues, Telecom Decision CRTC 97-9, 1 May 1997, the Commission indicated that it considers that it would be appropriate to grant ex parte treatment to tariff filings for uncapped services. The Commission, however, does not consider the proposed FLEX Access service to be an uncapped service.
2. In light of the foregoing, the Commission will not consider this filing on an ex parte basis. The company is directed to provide an abridged copy of the application for the public record in all relevant public examination rooms within two business days.
