    Public Notice CRTC 1998-19

    The Commission has received the following application:

    1.  EASTERN CANADA AND IGLOOLIK, HALL BEACH, POND INLET, ARCTIC BAY, RESOLUTE BAY AND GRISE FIORD, Northwest Territories

    Application (199800834) by TMN NETWORKS INC./RÉSEAUX TMN INC. ("TMN") to amend the broadcasting licence of the English-language (Pay Television) programming undertaking known as MOVIEPIX by amending that part of its condition of licence #1 which reads as follows:

    1. The licensee shall provide a regional, English-language general interest pay television programming service in Ontario, Quebec, New Brunswick, Nova Scotia, Prince Edward Island and Newfoundland.

    TMN is seeking to amend the above condition of licence by extending its service area to include Igloolik, Hall Beach, Pond Inlet, Arctic Bay, Resolute Bay and Grise Fiord, Northwest Territories.

    As part of the rationale for the proposed amendment, TMN submits that the Northwest Territories communities are in the service area licensed to WIC Premium Television Ltd. ("WIC") (formerly Allarcom Pay Television Limited) programming service known as MOVIEMAX. However, because WIC has changed its integrated receiver decoders the communities are no longer able to receive the MOVIEMAX signal. WIC is presently trying to determine the best means of reestablishing the service to these communities.

    TMN has undertaken to cease offering the MOVIEPIX service to these Northwest Territories communities when WIC's MOVIEMAX service becomes available in the communities.

    The Commission notes that a similar application to provide The Movie Network service to these communities was approved in Decision CRTC 98-2, dated 7 January 1998. Taking into account the aforementioned loss of service, and the particular needs of remote, Arctic communities, the Commission intends to approve any further requests of this nature administratively.

In the event that the application is brought to the oral phase of a hearing it would be helpful to the Commission if you provide reasons why your written comments are not sufficient and an appearance is necessary;

    Your intervention will be considered by the Commission, and will form part of the public record of the proceeding without further notification to you, provided the procedure set out above has been followed. You will be contacted only if your submission raises procedural questions.
