TÉLÉBEC LTÉE AND QUÉBEC-TÉLÉPHONE - FORBEARANCE FROM THE REGULATION OF
PACKET DATA SERVICES

1. On 5 February 1998, Télébec ltée (Télébec)
filed an application pursuant to section 34 of the Telecommunications
Act (the Act), requesting forbearance from the regulation of the
company's Datapac, Hyperpac, future X.25 packet data and frame relay
services. In particular, Télébec requested that the Commission refrain from
exercising all powers and performing all duties under sections 24 (in
part), 25, 29, 31 and subsections 27(1), 27(5) and 27(6) of the Act. |

2. Télébec also requested forbearance from the
regulation of the company's current and future dedicated interexchange
private line (IXPL) services. |
|
3. On 14 April 1998, Québec-Téléphone filed an
application requesting forbearance from the regulation of the company's
Datapac, Hyperpac, future X.25 packet data and frame relay services.
Specifically, Québec-Téléphone requested that the Commission refrain from
exercising all powers and performing all duties under sections 24 (in
part), 25, 29 and 31 and subsections 27(1), 27(5) and 27(6) of the Act. |

4. The Commission seeks comment regarding the
appropriateness of forbearing pursuant to section 34 of the Act with
respect to the companies' Datapac, Hyperpac, future X.25 packet data and
frame relay services. The Commission notes that, in Review of Regulatory
Framework, Telecom Decision CRTC
94-19, 16 September 1994, it
detailed the factors that it would consider when assessing whether a
particular market is or will be sufficiently competitive for the Commission
to refrain from regulation. These factors should be addressed by parties in
their submissions. |

5. The Commission notes that in Télébec
ltée and Québec-Téléphone - Forbearance from the Regulation of
Interexchange Private Line Services, Telecom Public Notice CRTC
98-26, also issued today, it is seeking comments
on that part of Télébec's application related to its request for
forbearance from the regulation of the company's current and future
dedicated IXPL services. |
