Telecom Order CRTC 99-1223

  Ottawa, 23 December 1999
  On 29 October 1999, pursuant to Telecom Order CRTC 99-941, 30 September 1999 (Order 99-941), the Canadian Alliance of Publicly-Owned Telecommunications Systems (CAPTS) requested final approval of its members' revised 1998 Carrier Access Tariffs (CATs).

  1. CAPTS' filing was in accordance with Order 99-941, except it had increased the total amount of its members' estimated 1996 Fund administration fee by approximately $34,000 in calculating its 1997 contribution rates, which was then flowed through to its final 1998 contribution rates.
  2. In an order of today's date, the Commission denied CAPTS' request to increase its estimated 1996 Fund administration fee for the purposes of calculating its 1997 contribution rates. Accordingly, the resulting lower 1997 base contribution requirements are reflected in the approved final 1998 contribution rates.
  3. In light of the foregoing, the Commission orders that:
  (a) CAPTS members' revised final 1998 contribution rates are denied;
  (b) the contribution and direct toll rates listed in the attached table are approved on a final basis for the period 1 January 1998 to 31 December 1998;
  (c) CAPTS is to issue, within 15 days, revised tariff pages reflecting the approved CAT rates for its members; and
  (d) CAPTS is to file within 30 days:
  (i) actual 1998 Phase III results which include the revised CAT revenues calculated based on the approved rates in the attached table; and
  (ii) actual rates of return for 1998 for the regulated portion of the company and in the event that a company has over-earned in a particular year, the amount that will be refunded to toll providers.
