Telecom Order CRTC 99-260

 

TELUS Communications Inc. has proposed tariff revisions under Tariff Notice (TN) 37 dated 25 January 1999 and TN 37A dated 12 February 1999, to introduce a promotional plan called the Smart Business Savings Pac Promotion.

1.In the two applications, the company proposed to offer customers a bundle consisting of business individual line or multiline (maximum of two lines) and three SmartTouch features at certain promotional rates. The company also proposed to offer those customers discounts on selected customer premises equipment (CPE) and subscriptions to bolded white page listings (TN 37) and bolded white and yellow listings (TN 37A).

 

2.The Commission notes that bundling of CPE with local services is not allowed under the current regulatory regime. Further, the Commission notes that the combined period of enrolment and discounted subscription on directory listings would be about 16 months. The Commission does not consider the subject promotion to be a legitimate promotion of limited duration that is exempt from the application of the imputation test.

 

3.The Commission therefore denies TNs 37 and 37A.
