Telecom Order CRTC 99-356

 

On 4 February 1999, Sogetel inc. (Sogetel) filed an application under Tariff Notice (TN) 77, amended by TN 77A dated 3 March 1999, to introduce Asymmetric Digital Subscriber Line (ADSL) Service.

1.Sogetel's proposed ADSL Access Service would allow a service provider to offer retail high-speed data services on a subscriber's existing access line.

 

2.The proposed service provides for simultaneous voice and high-speed data transmission on a local loop.

 

3.Sogetel did not file costing information in support of the proposed rates since they are identical to those charged by Québec-Téléphone for a similar service. Sogetel noted that it is the Commission's practice not to require the company to provide costing support on new services where the proposed rates are similar to those previously approved for other carriers.

 

4.The Commission notes that Sogetel's proposed ADSL Access Service rates reflect the rates charged by Québec-Téléphone in the context of a market trial.

 

5.In Telecom Order CRTC 99-291, dated 30 March 1999 (Order 99-291), the Commission approved the introduction of a new ADSL Access Service for Québec-Téléphone. Québec-Téléphone's new approved rates differ from those proposed by Sogetel.

 

6.The Commission is of the view that Sogetel should charge the same rates as approved for Québec-Téléphone in Order 99-291.

 

7.The Commission also notes that Sogetel's proposed service does not provide an option allowing a service provider to co-locate its own high-speed or ADSL access equipment in Sogetel's central offices.

 

8.The Commission is of the view that upon request by a service provider, Sogetel should file a tariff to allow a service provider to access subscriber loops for the purposes of providing ADSL service. In addition, the company would be required to allow a service provider to co-locate its ADSL equipment in the company's central office.

 

9.In light of the foregoing, the Commission approves the proposed tariff revisions effective 17 May 1999, with the exception of the monthly rates for the single line residential and single line business access rate elements which are to be set at $25.00 and $50.00 respectively.
