TELUS COMMUNICATIONS INC. - PROCEEDING TO REVIEW AMALGAMATION OF REGULATORY REGIMES

I INTRODUCTION

1.Price cap regulation was implemented for TELUS Communications Inc. (TCI) on 1 January 1998 based on the regulatory framework set out in Price Cap Regulation and Related Issues, Telecom Decision CRTC 97-9, 1 May 1997 (Decision 97-9). The Commission approved price cap regulation for TELUS Communications (Edmonton) Inc. (TCEI) effective 1 January 1999 in TELUS Communications (Edmonton) Inc. - Decision Regarding Form of Regulation and Other Matters, Telecom Decision CRTC 98-23, 30 November 1998. The Commission found that, subject to two exceptions (regarding the price cap period and Phase III filing requirements), the price cap regime in Decision 97-9, as set out for TCI, was appropriate for TCEI.

2.By letter dated 2 December 1998, TCI informed the Commission that, among other things, the Board of Directors of TELUS Corporation have approved a legal reorganization of its subsidiary companies, effective 1 January 1999. This reorganization included the amalgamation of TCI, TCEI and certain other subsidiaries.

3.TCI provided service in the province of Alberta, except for the city of Edmonton for which service was provided by TCEI. The amalgamated company, TELUS COMMUNICATIONS Inc. (TELUS), will provide service throughout the province of Alberta.

4.The amalgamation of TCI and TCEI raises the issue of when and how the regulatory regimes and rules established separately for TCI and TCEI should be combined and applied to TELUS.

5.The Commission notes that the price cap filings for TCI and TCEI would have been required by 31 March 1999. In order to ensure that the price cap parameters for TELUS are properly established prior to the 31 March 1999 filing date, the Commission must address the issue of when the two price cap plans should be amalgamated.

II ISSUES

6.The Commission is of the preliminary view that the price cap plans of TCI and TCEI should be amalgamated prior to the 31 March 1999 filing date. However, the Commission is also of the preliminary view that, as a transitional regime for TELUS, the 10% annual limit on annual increases should apply to individual rate elements for residence and single-line business primary exchange services in the territory formerly served by TCEI for the year 1999.

7.The Commission invites comment on the views expressed above. The Commission notes that all other issues arising from the amalgamation of TCI and TCEI, such as those relating to rate bands and subsidy ratios, will be addressed separately as required.

III PROCEDURE

8.TELUS is made a party to this proceeding. Other parties wishing to participate in this proceeding must notify the Commission of their intention to do so by writing to the Secretary General, CRTC, Ottawa, Ontario, K1A 0N2, fax: (819) 953-0795, by 19 January 1999. Parties are to indicate in the notice their Internet email address, where available. If parties do not have access to the Internet, they are to indicate in their notice whether they wish to receive disk versions of hard copy filings. The Commission will issue as soon as possible after the registration date a complete list of parties and their mailing addresses (including Internet email addresses, if available), identifying those parties who wish to receive disk versions.

9.Parties may file comments with the Commission, serving copies on all other parties, by 26 January 1999.

10.Parties may file reply comments with the Commission, serving copies on all other parties, by 2 February 1999.

11.Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
