Application for costs by l'Association coopérative d'économie familiale (ACEF) des Bois-Francs.

 

Positions of parties

1.

By letter dated 29 June 2000, ACEF applied for an award of costs regarding its intervention in the above-noted proceeding.

2.

By letter dated 18 September 2000, ACEF revised its application to conform to the Guidelines for the Taxation of Costs (the Guidelines), as amended on 15 May 1998.

3.

ACEF submitted that it represents consumers interested in the issues reviewed in the proceeding, that it participated in a serious manner and that it contributed to a better understanding of the questions at issue by having commented on Télébec's application.

4.

ACEF requested that the costs be fixed in the adjudication process.

5.

By letter dated 6 October 2000, Télébec stated that it had no comments in response to ACEF's request.

 

Commission determination

The Commission considers that ACEF's participation in this proceeding satisfies the requirements of section 44 of the CRTC Telecommunications Rules of Procedure. ACEF, which represents consumers, participated in a responsible manner and contributed to a better understanding of the issues in the proceeding.

Given the small size of ACEF's claim and the relative brevity of this proceeding, the Commission considers that this is an appropriate case to dispense with taxation and fix the costs.

8.

The Commission has examined the amounts claimed by ACEF and considers them to be reasonable and necessarily incurred and in conformity with the Guidelines.

9.

The application for an award of costs of the above-mentioned proceeding is approved. Pursuant to subsection 56(1) of the Telecommunications Act, the Commission fixes the costs to be paid to ACEF at $1,200.

10.

Télébec shall pay forthwith the costs awarded herein.
