Power increase for CBF-FM

1.

The Commission approves the application to amend the broadcasting licence for CBF-FM Montréal by increasing its effective radiated power from 17,030 watts to 100,000 watts.

The Commission authorizes the licensee to operate the undertaking on the basis of the contours and particulars resulting from the above-mentioned change.

The CBC stated that this power increase will improve the service of "la Première Chaîne" provided by CBF-FM in greater Montréal, particularly in the outlying metropolitan areas.
Interventions

Metromedia CMR Broadcasting Inc. (CMR), licensee of CFQR-FM and CIEL-FM Montréal, and Groupe Radio Astral (Astral), licensee of CKMF-FM Montréal, submitted interventions to this application. Both interveners argued that CBF-FM's proposed power increase would cause interference to the signal of their FM stations which operate in Montréal. They also claimed that the CBC's technical briefs failed to include analysis on the potential for interference to aeronautical NAV/COM services.

For its part, CMR opposed the application on the grounds that approval would create a precedent for similar requests from other radio licensees broadcasting from the Mont Royal site.

Astral noted that it plans to file an application with the Commission to increase the power of its station, CKMF-FM. While not opposing the CBC's proposal, in principle, Astral asked the Commission to consider the Corporation's application in conjunction with the proposed application for CKMF-FM and only after the Commission has rendered a decision on that proposal. Astral would oppose the CBC's application in the event that the Department of Industry refused a power increase for CKMF-FM.

The CBC responded that its technical analyses conform to the methods established and recognized by the Department of Industry. According to these studies, CBF-FM's proposed power increase will not cause interference to other Montréal FM stations. The CBC also noted that its proposal has received the required technical approvals.

The CBC further argued that suspending study of its present application would delay the Commission's decision by several months, causing undue hardship to CBF-FM's listeners. The CBC maintained that the two applications should be treated separately and independently because Astral's proposed application would be based on different technical parameters from those proposed for CBF-FM. The Commission notes that Astral has not yet submitted an application to increase CKMF-FM's power.

The Commission is satisfied with the CBC's response.

The Commission notes that the Department of Industry has indicated that the CBC's application is conditionally technically acceptable. The Department will only issue a broadcasting certificate once it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

In accordance with section 22(1) of the Broadcasting Act, the above-mentioned amendment will only be valid when the Department of Industry certifies to the Commission that its technical requirements have been met and that a broadcasting certificate has been or will be issued.
