Acquisition of assets

1.

The Commission approves the application for authority to acquire the assets of radio programming undertaking CHEQ-FM Sainte-Marie-de-Beauce, from Gestion Overtime inc., and for a broadcasting licence to continue the operation of this undertaking.

Upon surrender of the current licence, the Commission will issue a licence to 9079-3670 Québec inc. The licence will expire 31 August 2002, the current expiry date, and will be subject to the conditions specified in the licence to be issued.

The Commission notes that the applicant did not propose any tangible benefits; CHEQ-FM has been unprofitable over the three years preceding filing of this application. In accordance with its policy for commercial radio, the Commission will forego benefit requirements for this station. The Commission notes the important benefit associated with this transaction, that being the maintenance of CHEQ-FM as a viable, local radio service. Accordingly, the Commission is of the view that approval of this application is in the public interest.

The applicant intends to broadcast 126 hours of local programming per week. Of this total, 21 hours will be spoken word programming and will include 8 hours of local news (information and sports).

In the area of Canadian talent development, the applicant indicated that it would contribute to the Canadian Association of Broadcasters’ funding plan (Public Notice CRTC 1995-196).

In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled Implementation of an employment equity policy, the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.

The Commission acknowledges the intervention submitted by l’Association québécoise de l’industrie du disque, du spectacle et de la vidéo (ADISQ).
