New low-power television programming undertaking

1.

The Commission approves the application for a broadcasting licence for an English and French-language low-power television programming undertaking at Isle Madame, on channel 10, with a transmitter power of 50 watts.

The Department of Industry has advised that the undertaking will have a power of 50 watts rather than 45.3 watts as indicated in Notice of Public Hearing CRTC 1999-10 dated 1 October 1999.

Subject to the requirements of this decision, the Commission will issue a licence expiring 31 August 2006. This licence will be subject to the conditions specified in this decision and in the licence to be issued.

The Commission notes that the applicant intends to initially broadcast approximately 15 hours per week of programming, (5 hours of original programming, repeated twice), which will consist of a 50-minute original feature presentation, TV Bingo, community meetings and sporting events as well as some programming obtained from other communities. In addition, alphanumeric advertising with background audio in English and French will be transmitted. The applicant has stated its intention to increase the amount of original programming.

The programming broadcast will be 85% English and 15% French; however, the applicant stated that the French-language programming will increase to 25%-30% to meet the needs of the Acadian population.

The licensee is relieved, by condition of licence, from the requirements of sections 10(1) to 10(4) of the Television Broadcasting Regulations, 1987 (the regulations) with regard to the retention of program logs or records.

The licensee is reminded that it must retain a clear and intelligible audio-visual recording of all its programming, and furnish such recording, upon request, to the Commission, pursuant to the requirements of sections 10(5) and 10(6) of the regulations.

The licence will only be issued and effective when the undertaking is ready to begin operation. When the licensee has completed construction and is prepared to commence operation, it must advise the Commission in writing. If the undertaking is not constructed and ready to operate within 12 months of today’s date, extensions to this time frame may be granted provided that the licensee applies in writing to the Commission before the 12-month period or any extension of that period expires.

The Commission acknowledges the 64 interventions submitted in support of this application.
