Re: Revised Procedures Related to Bell Canada Tariff Notice 6622 - Asymmetric Digital Subscriber Line (ADSL) Access Service

By e-mail dated 7 November 2001, Mr. F. Menard proposed, among other things, revisions to the process associated with the above application, including an interrogatory phase, and requested that, pending disposition of TN 6622, the Commission grant the interim relief sought by the Independent Members of the Canadian Association of Internet Providers (IMCAIP) in its Part VII application of 15 August 2001 addressing Bell Canada (Bell) and its affiliates' DSL services

By letter dated 13 November 2001, Bell Canada submitted that Mr. Menard's various requests should be denied.

Following careful consideration, it is considered that an interrogatory phase would be appropriate with respect to this proceeding. Set below is the revised process applicable to this matter.

  1. Interveners may file interrogatories with the Commission, serving a copy on Bell, by 23 November 2001.
  2. Bell is to file its responses to interrogatories with the Commission, serving copies on all interveners, by 7 December 2001.
  3. Requests by interveners for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure information for which confidentiality has been claimed, setting out detailed reasons for disclosure, are to be filed with the Commission, and served on Bell, by 14 December 2001.
  4. Bell may file written responses to requests for further disclosure and for public disclosure with the Commission, serving copies on all interveners, by 21 December 2001.

It is intended that the milestones for the remainder of the process be set out in the letter disposing of the requests for further responses and for public disclosure. It is expected that this letter will be issued very early in the New Year.

With respect to Mr. Ménard's interim relief request, it is noted that this is the same relief sought by IMCAIP in its Part VII application of 15 August 2001. Given that this matter is currently before the Commission in that proceeding, it would not be appropriate to address it in this proceeding.

Where a document is to be filed or served by a specific date, the document should be received, not merely sent, by that date.
