Treatment of revenues derived from wireless terminal handsets

Application for costs by the Public Interest Advocacy Centre (PIAC)

Background

1.

By letter dated 4 December 2001, the Public Interest Advocacy Centre (PIAC) applied for its costs associated with its participation in the proceeding regarding a Part VII application by TELUS Communications Inc. (TCI) relating to the treatment of the wireless terminal handsets subsidy in the calculation of contribution-eligible revenues.

Position of the parties

PIAC submitted that it satisfied the criteria for an award of costs set out in section 44 of the CRTC Telecommunications Rules of Procedure (the Rules).

PIAC requested that the Commission consider its application on an expedited basis, together with its Bill of Costs, totalling $1,216.66.

The Commission notes that PIAC did not provide submissions with respect to the appropriate respondents to this application. However, PIAC provided TCI with a copy of its application.

In its 10 December 2001 letter to the Commission, TCI stated that it did not oppose PIAC's application for costs in the amount of $1,216.66.

Commission determination

The Commission considers that PIAC has satisfied the criteria for an award of costs under section 44 of the Rules.

The Commission also considers that this is an appropriate case in which to dispense with taxation and fix the costs in accordance with the streamlined procedure set out in Telecom Public Notice CRTC 98-11, New procedure for telecom costs awards, dated 15 May 1998.

The Commission is of the view that the amount claimed by PIAC was reasonably and necessarily incurred and should be allowed.

Considering the small amount claimed and the fact that TCI was the applicant in this proceeding, the Commission is of the view that TCI should be the respondent.

Directions as to costs

The Commission approves PIAC's application for costs in this proceeding. Pursuant to section 56(1) of the Telecommunications Act, the Commission fixes the costs to be paid to PIAC at $1,216.66

11.

For the reasons mentioned above, the Commission directs that the award of costs to PIAC be paid by TCI forthwith.
