Application by THE SCORE TELEVISION NETWORK LTD. to amend the licence of the Category 2 nationalspecialty television service known as The Score.

 

The licence held by The Score Television Network Ltd. for the national English-language specialty programming undertaking is currently subject to conditions of licence related to industry codes on gender portrayal and the depiction of violence. The conditions of licence are as follows:

 

8. The licensee shall adhere to the guidelines on gender portrayal set out in the Canadian Association of Broadcasters' (CAB) "Sex-Role Portrayal Code for Television and Radio Programming", as amended from time to time and approved by the Commission.

 

9. The licensee shall adhere to the provisions of the CAB's "Broadcast Code for Advertising to Children", as amended from time to time and approved by the Commission.

 

The applicant requests that the current conditions be replaced by "suspensive" conditions on the same matters, meaning that the application of the conditions would be suspended, so long as The Score Television Network Ltd. remains a member in good standing of the Canadian Broadcast Standards Council. The requested change requires an amendment to the licence.

Application by THE BASE COMMANDER OF CANADIAN FORCES BASE, SUFFIELD ALBERTA, Lieutenant-Colonel C.H. Watson and his successors, Canadian Forces Base Suffield to amend the licence of radio station CKBF-FM CFB, Suffield, Alberta.

 

The licensee proposes to add an FMtransmitter atWainwright (CFB) to broadcast the programming of CKBF-FM CFB Suffield, to adequately serve the British Armed Forces personnel and their dependents stationed at Wainwright CFB.

 

This service is exclusively designed for the British Forces based at Canadian Forces Bases of Wainwright and Suffield, Alberta.

 

The transmitter will operate on frequency 101.5 MHz (channel 268LP) with an effective radiated power of 30 watts.

Application by ABORIGINAL VOICES RADIO INC. to amend the licence of the radio station at Vancouver.

 

The licensee proposes to add an AM transmitter atAbbotsford to broadcast the programming of the Aboriginal-language radio station at Vancouver, which was approved in Decision CRTC 2001-314, to adequately serve the population of Abbotsford and Fraser Valley, as well as Vancouver. The Abbotsford transmitter is proposed because the Vancouver transmitter (see item #4) would not serve the Abbotsford area.

 

The transmitter will operate on frequency 850 kHz with a transmitter power of 10,000 watts.

 

This frequency was previously licenced to Rogers Radio (British Columbia) Ltd. to operate their AM station CFSR Abbotsford.

 

In Decision CRTC 2001-317 the Commission approved Rogers Broadcasting Limited on behalf of Rogers Radio (British Columbia) Ltd. to convert CFSR Abbotsford to the FM band on the frequency 107.1 MHz (channel 296A).

 

This decision included the following statement:

 

"The Commission notes, and considers as significant, the applicant's commitment, depending upon receipt of approval of this application to make CFSR's current AM transmitting facilities, now operating on the frequency of 850 kHz, available for use by another party without charge for a period of seven years."

Application by ABORIGINAL VOICES RADIO INC. (AVR) to amend the licence of the radio station at Vancouver.

 

In Decision CRTC 2001-314 dated 5 June 2001, the Commission approved an application by the licensee to operate an Aboriginal-language FM radio station in Vancouver. However, the Commission did not approve the proposed frequency (90.9 MHz, channel 215B).

 

The applicant was requested to file an application proposing the use of a different frequency. The applicant now proposes to operate the transmitter on frequency 92.3 MHz (channel 222C1) with an effective radiated power of 1,200 watts.

 

This application was initially scheduled for the 12 August 2002 Gatineau Public Hearing. The Canadian Broadcasting Corporation (CBC) and Rogers Broadcasting Limited (Rogers) filed interventions opposing the AVR application. The CBC indicated in its intervention that AVR could use one of two other frequencies for its proposed transmitter [104.1 MHz (channel 281) or 106.3 MHz (channel 292)]. Subsequent to these interventions, the Commission decided to withdraw this application from the 12 August 2002 hearing and allow AVR to do a technical analysis of alternate frequencies and transmitting sites that was requested by Industry Canada as a condition of its technical approval. The analysis has since been filed with Industry Canada and the Commission along with CBC's and Rogers' comments pertaining to the analysis.

 

Industry Canada advised the Commission that it would be prepared to approve the application by AVR to use 92.3 MHz on Mt. Seymour, provided that the antenna of the CBC transmitter CBU-FM-1 Victoria located on Saltspring Island be changed to accommodate the AVR proposal.

 

In Decision CRTC 2002-129, Use of 90.9 MHz by the CBC's new French-language station at Vancouver, the following is noted:

 

Simon Fraser and the Vancouver Metis Association filed interventions supporting the CBC's present application on condition that it modify its transmitter CBU-FM-1 Victoria, located on Saltspring Island, so that AVR could use 92.3 MHz (channel 222) for its Vancouver station. The CBC responded that it would consider modifying CBU-FM-1's antenna pattern to make 92.3 MHz a more viable option for AVR. The Commission accordingly expects the CBC to propose suitable modifications to its transmitter, CBU-FM-1 Victoria, in order to accommodate AVR's proposal to use 92.3 MHz in Vancouver.

 

Because of the new material being placed on the examination/public file, the Commission is now seeking additional comments regarding this application. Since the previously filed interventions will be considered in this proceeding as well, the additional comments should not duplicate those filed previously.
