  Further to its Broadcasting Notices of Public Hearing CRTC 2003-8 dated 21 August 2003 and 2003-8-1 dated 11 September 2003 relating to a Public Hearing which will be held on 20 October 2003 at 9:30 a.m., at the Conference Centre, Portage IV, 140 Promenade du Portage, Gatineau, Quebec, the Commission announces that it will also consider the following. The intervention deadline is 6 October 2003.

  Application by ROGERS CABLE INC., on behalf of itself and its subsidiaries Rogers Cablesystems Ontario Limited, Rogers Cablesystems Georgian Bay Limited, Rogers Ottawa Limited, Rogers Cable Atlantic Inc. (Rogers), to implement an intra-corporate reorganization involving their cable distribution and video-on-demand (VOD) programming undertakings in the above noted localities.
  The proposed intra-corporate reorganization has five (5) steps which are expected to occur simultaneously on 31 December 2003.
  Following the intra-corporate reorganization, Rogers Cable Inc. would be the sole shareholder of a new subsidiary company ("Cable Licensee") that will hold all the licenses to operate cable distribution undertakings in Ontario, Quebec, New Brunswick and Newfoundland/Labrador and the national licence to operate a VOD undertaking. At that time, Rogers would no longer hold any broadcasting licenses and would therefore cease to be a broadcasting licensee.
  The Commission notes that this intra-corporate reorganization would not result in a change in the ultimate control over the cable distribution and VOD licenses referred to in the subject application. Ultimate control would remain under Rogers Communications Inc.

  Your intervention will be considered by the Commission, and will form part of the public record of the proceeding without further notification to you, provided the procedure set out below has been followed. You will be contacted only if your submission raises procedural questions.

  A true copy MUST be sent to the applicant and proof that this has been done must accompany the intervention sent to the Commission.

  Your intervention should clearly identify the application and indicate whether you support or oppose the application, or if you propose changes to it, include the facts and grounds for your proposal.
