Brooke Telecom Co-operative Ltd.

Forbearance

1.

The Commission received an application by Brooke Telecom Co-operative Ltd. (Brooke), dated 19 November 2002, to revise General Tariff sections 120, Telephone Set Loss Charge; 240, Multi-Line Telephone Systems and Key Equipment; and 490, Miscellaneous Equipment and Services, in order to reflect forbearance from the regulation of competitively provided terminal equipment.

In is application, Brooke noted that it no longer has any two or four party line services and therefore does not provide any terminal equipment which should be subject to regulation.

Brooke also proposed to remove item 4, Touch Call (Push-button Dialling), under section 490. Brooke noted that Touch-Tone dialling has been included as a part of individual line service since 1999.

The Commission notes that the application was filed pursuant to Regulatory framework for the independent telephone companies in Quebec and Ontario (except Ontario Northland Transportation Commission, Québec-Téléphone and Télébec ltée), Telecom Decision CRTC 96-6, 7 August 1996.

The Commission received no comments with respect to the application.

The Commission approves Brooke's application. The revisions take effect as of the date of this order.

7.

Brooke is to issue revised tariff pages forthwith to reflect these changes.
