TELUS Communications Inc.

Integrated services digital network - Primary rate interface service

1.

The Commission received an application by TELUS Communications Inc. (TCI), dated 30 September 2003, to revise the former TCI General Tariff item 495, Integrated Services Digital Network - Primary Rate Interface (ISDN-PRI) service.

TCI proposed to add three optional features to ISDN-PRI service in Alberta. In particular, TCI proposed to provide the following features:
 
  • the Retain Directory Number (Retain DN) feature at no monthly rate for 1 to 9 directory numbers and at a monthly rate of $24.50 per block of 10 directory numbers. A one-time service charge of $35.00 per directory number up to a maximum of $250.00 would apply;
 
  • the Call Forward Busy (One-way) feature at no monthly rate. A one-time service charge of $250.00 would apply; and
 
  • the Call Forward Busy (Two-way) feature at a monthly rate of $150.00 per ISDN-PRI System Group. A one-time service charge of $650.00 would apply.

TCI provided a cost study in support of the proposed rates for the service.

TCI noted that it had been providing Retain DN and Call Forward Busy (One-way) to its ISDN-PRI service customers in Alberta without an approved tariff. TCI stated that it was proposing to add these optional features to its tariff at their current rates in order to allow continuation of service under tariff. TCI requested that the Commission ratify the charging of the rates for Retain DN and Call Forward Busy (One-way) prior to the date of the Commission's approval of the application.

TCI further proposed that these optional features be assigned to the Other capped services basket, consistent with the price cap treatment of other optional features for ISDN-PRI service. TCI noted that the Retain DN and Call Forward Busy (One-way) revenues were not included in the Other capped services basket. TCI submitted that the overall revenue impact resulting from the inclusion of these service elements was immaterial and that TCI's price cap constraints have been met.

The Commission received no comments with respect to this application.
 

Commission analysis and determination

The Commission notes that in Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34, 30 May 2002, ISDN-PRI service and the associated optional features were assigned to the Other capped services basket. The Commission therefore considers it appropriate to assign Retain DN, Call Forward Busy (One-way) and Call Forward Busy (Two-way) to the Other capped services basket.

The Commission notes that the proposed rates for a service must satisfy the imputation test. The Commission further notes that the imputation test is the accepted method, under the current regulatory regime, of determining whether the proposed rates would be anti-competitive. The Commission finds that the proposed rates for ISDN-PRI service satisfy the imputation test.

The Commission approves the proposed tariff revisions. The revisions to this tariff take effect as of the date of this order.

With respect to TCI's request for Commission ratification for this service prior to the date of its approval, subsection 25(4) of the Act states the following:
 

Notwithstanding subsection (1), the Commission may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if the Commission is satisfied that the rate:

 

(a) was charged because of an error or other circumstance that warrants the ratification; or

 

(b) was imposed in conformity with the laws of a province before the operations of the carrier were regulated under any Act of Parliament.

The Commission notes that TCI provided no information that would satisfy paragraph 25(4)(a) of the Act and TCI does not meet the criterion on the requirements set out in paragraph 25(4)(b) of the Act.

12.

As section 25 of the Act does not apply, the Commission denies TCI's request to ratify charging for this service prior to the date of approval of this application.
