CHRD-FM Drummondville and CFEI-FM Saint-Hyacinthe - Licence amendments

  The Commission approves the application by Astral Média Radio inc. (formerly Astral Radio inc.) to amend the broadcasting licences for CHRD-FM Drummondville and CFEI-FM Saint-Hyacinthe in order to be allowed to broadcast a lower level of Canadian popular music on these "oldies" radio stations.
 

The applications

The Commission received applications by Astral Média Radio inc. (Astral) (formerly Astral Radio inc.) to amend the broadcasting licences for CHRD-FM Drummondville and CFEI-FM Saint-Hyacinthe in order to be allowed to broadcast a lower level of Canadian popular music on these "oldies" radio stations.
 

Intervention

The Commission received an intervention by the Association québécoise de l'industrie du disque, du spectacle et de la vidéo (ADISQ) that commented on these applications.

ADISQ noted that CHRD-FM and CFEI-FM broadcast a musical repertoire from the 1970s. According to ADISQ, there is sufficient available Canadian musical repertoire to meet each station's current minimum Canadian content requirements. Furthermore, ADISQ criticized the fact that Astral did not demonstrate that it had conducted a thorough review of the Canadian Francophone and Anglophone musical repertoire from the time period in question.
 

The licensee's response

In response to ADISQ's intervention, Astral noted that an error appeared in each of its applications, incorrectly indicating that the stations' musical format focuses on music (oldies) "from the 1970s." The sentence should have read "from the 1960s and 1970s."

Astral stated that the music programming offered by the BOOM-FM network, which includes CHRD-FM and CFEI-FM, conforms completely to the Commission's definition of the "oldies" radio station format.

Furthermore, Astral maintained that it does not need to prove that there is a short supply of Canadian musical selections because that has been amply demonstrated in the past.

Astral noted that the proposed condition of licence applies only during the weeks when 90% of musical selections played are from before 1 January 1981.
 

The Commission's analysis and determination

In Regulations Amending the Radio Regulations, 1986 - Commercial Radio Programming, Public Notice CRTC 1998-132, 17 December 1998 (Public Notice 1998-132), the Commission announced amendments to the Radio Regulations, 1986 that require commercial radio stations to broadcast a minimum level of 35% of Canadian popular music, both over the broadcast week and between 6 a.m. and 6 p.m. Monday to Friday. At the same time, the Commission established that radio stations whose formats are based on the presentation of older music could request flexibility to broadcast a minimum level of 30% of Canadian musical selections.

Consistent with the policy outlined in Public Notice 1998-132, the Commission approves the application by Astral Média Radio inc. to amend its broadcasting licence for CHRD-FM and CFEI-FM in order to add the following condition of licence:
 

The licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986, in any broadcast week where at least 90% of musical selections from content category 2 that it broadcasts are selections released before 1 January 1981:

 

. 1 in that broadcast week, devote 30% or more of its musical selections from content category 2 to Canadian selections broadcast in their entirety; and

 

. 2 between 6 a.m. and 6 p.m., in the period beginning on Monday of that week and ending on Friday of the same broadcast week, devote 30% or more of its musical selections from content category 2 to Canadian selections broadcast in their entirety.

 

The licensee will also be responsible for specifying, on the music lists it provides to the Commission, the year of release for all musical selections it broadcasts.

 

For the purposes of this condition, the terms "broadcast week", "content category" and "musical selection" shall have the meaning set out in section 2 of the Radio Regulations, 1986.
