CHME-FM Les Escoumins - Technical change

  The Commission approves the application to change the authorized contours of the radio programming undertaking CHME-FM Les Escoumins by increasing the average effective radiated power from 567 watts to 2,559 watts.
 

The application

The Commission received an application by Radio Essipit Haute-Côte-Nord to amend the broadcasting licence for the radio programming undertaking CHME-FM Les Escoumins, by increasing the average effective radiated power (ERP) from 567 watts to 2,559 watts.

The applicant indicated that the proposed change is intended to improve the reception quality of its signal for listeners in the upper north shore of Quebec.
 

Interventions

The Commission received two interventions in connection with this application, one by 9022-6242 Québec Inc., the licensee of CHLC-FM Baie-Comeau and CFRP Forestville, and the other by Radio CJFP 1986 Ltd. /CIBM-FM Mont Bleu Ltd., the licensees of CIEL-FM and CIBM-FM Rivière-du-Loup, respectively.

9022-6242 Québec Inc. questioned CHME-FM's status as a Native radio station. The intervener stated that only the ownership of CHME-FM is Aboriginal and submitted that the station appears to be operating as a commercial undertaking. 9022-6242 Québec Inc. asked the Commission to ensure that the Native radio station on the Essipit des Escoumins Indian Reserve does not solicit advertising in the authorized service area of the intervener's stations in Baie-Comeau and Forestville.

Radio CJFP 1986 Ltd. /CIBM-FM Mont Bleu Ltd. expressed concern that the proposed contours would extend CHME-FM's signal to the Rivière-du-Loup market. The intervener also requested that the Commission impose a condition of licence on CHME-FM prohibiting all sales of advertising on the south shore of Quebec.
 

The applicant's response

In response, Radio Essipit Haute-Côte-Nord assured the interveners that CHME-FM will serve the upper north shore of Quebec and not provide any services, including weather or news, to south shore residents. The applicant also indicated that CHME-FM would not solicit south shore businesses to buy advertising. Furthermore, Radio Essipit Haute-Côte-Nord stated that its technical decisions were dictated by geographic requirements. Radio Essipit Haute-Côte-Nord did not respond to 9022-6242 Québec Inc.'s allegations regarding CHME-FM's status as a Native station.
 

The Commission's analysis and determination

The Commission is satisfied with the applicant's response and concludes that the proposed technical change is intended to improve the reception quality of CHME-FM's signals for residents of the upper north shore of Quebec. The Commission also notes the applicant's commitment to continue to not solicit local advertising on the south shore, given that its signal is present in these markets. The Commission expects Radio Essipit Haute-Côte-Nord to abide by this commitment. With respect to the issue of CHME-FM's status as a Native station, the Commission expects Radio Essipit Haute-Côte-Nord to respect the objectives set out in Native Broadcasting Policy, Public Notice CRTC 1990-89, 20 September 1990.

The Commission approves the application by Radio Essipit Haute-Côte-Nord to change the authorized contours of the radio programming undertaking CHME-FM Les Escoumins by increasing the average ERP from 567 watts to 2,559 watts.

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will issue a broadcasting certificate only when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.
