Terms of service for early termination of contracted service

1.

The Commission received an application by MTS Communications Inc. (MTS), dated 18 December 2003, to revise General Tariff item 475, Rate schedule for primary exchange service, item 1980, Centrex, item 1982, Centrex 2, item 1985, National Centrex service, item 1987, Centrex PLUS, item 1990, Digital exchange service, item 1995, Microlink, and item 2000, Megalink service, in order to add the reference to the specific Article in the Terms of Service regarding early termination of service.

MTS stated that the proposed revisions would give customers the flexibility to migrate services to other contracted access services without incurring termination charges, provided that the monthly recurring charges under the new contract are of equal or greater value to those remaining under the customer's existing unexpired contract.

MTS stated that the proposal does not change the existing rates for the affected services.

The Commission received no comments with respect to the application.

The Commission finds that the proposal is an industry standard provision and it has approved equivalent tariff provisions for Saskatchewan Telecommunications and TELUS Communications Inc.

6.

The Commission approves MTS's application. The revisions take effect as of the date of this order.
