  The Commission has received the following application. The deadline for submission of interventions/comments is 14 October 2004.
1. Various locations in Ontario, Quebec, New Brunswick and Newfoundland/Labrador
Application No. 2004-0200-1
  Application by Rogers Cable Communications Inc. to amend the licences of its cable distribution undertakings serving the above-mentioned locations.
  The licensee has applied for a change to the provision of approval related to its current authorization to distribute a second set of 4+1 U.S. network signals (one affiliate of each of the CBS, NBC, ABC, FOX and PBS networks) and distant Canadian signals selected from the list of Part 3 Eligible Satellite Services. The licensee is permitted to offer these services on a discretionary basis as part of its digital service offering subject to a provision of approval that it adhere to the program deletion requirements contained in section 43 of the Broadcasting Distribution Regulations with respect to these services. However, this provision of approval is suspended upon approval of an agreement entered into with affected broadcasters or their representatives dealing with issues related to the distribution of these services.
  The licensee states that it has attempted to negotiate changes to the terms of its agreement with the Canadian Association of Broadcasters (CAB), but the parties have been unable to reach an agreement. Accordingly, the licensee has requested a change to its provision of approval that would permit it to continue distributing the above-noted services on a discretionary digital basis pursuant to alternative conditions, including the payment of $0.25 per subscriber per month to the CAB on behalf of affected broadcasters and the contribution of 0.4% of its gross annual broadcasting-related revenue to the Canadian production fund for small-market independent broadcasters.
