Broadcasting Decision CRTC 2005-1

  Ottawa, 12 January 2005
VDN Cable Inc., on behalf of a corporation to be incorporated
Toronto, Ontario
  Application 2004-0285-0
Public Hearing in the National Capital Region
4 October 2004

Cable broadcasting distribution undertaking

1.

The Commission approves the application by VDN Cable Inc., on behalf of a corporation to be incorporated (VDN), for a broadcasting licence to carry on a new Class 1 cable broadcasting distribution undertaking (BDU) to serve the municipality of Metropolitan Toronto, Ontario.

2.

The operation of this undertaking will be regulated in accordance with the Broadcasting Distribution Regulations. The licence will expire on 31 August 2011 and will be subject to the conditions set out therein.

3.

The Commission received 49 interventions in support of this application, and one intervention submitted by Rogers Cable Communications Inc. (Rogers), with respect to the distribution of TQS. Rogers expressed the view that, before the Commission issues a BDU licence to VDN, it should be satisfied that the applicant's proposed distribution of TQS meets all of the criteria for the distribution of a distant Canadian signal.

4.

The Commission is satisfied that the carriage by VDN of TQS meets all of the criteria for the distribution of a distant Canadian signal, as set out in Structural Public Hearing, Public Notice CRTC 1993-74, 3 June 1993.

Issuance of the licence

5.

The licence for this undertaking will be issued once the applicant has:

  • satisfied the Commission, with supporting documentation, that an eligible Canadian corporation has been incorporated in accordance with the application in all material respects, and

  • informed the Commission in writing that it is prepared to commence operations.

6.

The undertaking must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 12 January 2007. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before this date.

7.

The licensee may receive the signals that it is licensed to distribute over the air or through any licensed or exempted Canadian BDU which is licensed to supply signals to other distributors.

Employment equity

8.

In accordance with Implementation of an employment equity policy, Public Notice CRTC 1992-59, 1 September 1992, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
