Insertion of promotional material in the local availabilities of U.S. satellite services, distribution of additional signals and reception of a U.S. signal from an unlicensed Canadian source

The Commission approves the application by TELUS Communications Inc. (TELUS) to amend the broadcasting licence for its cable broadcasting distribution undertaking serving the communities noted above, in order to add the following condition of licence:
 

The licensee may, at its option, insert certain promotional material as a substitute for the "local availabilities" (i.e., non-Canadian advertising material) of non- Canadian satellite services. At least 75% of these local availabilities must be made available for use by licensed Canadian programming services for the promotion of their respective services, for the promotion of the community channel and for unpaid Canadian public service announcements. A maximum of 25% of the local availabilities may be made available for the promotion of discretionary programming services and packages, customer service information, channel realignments, cable FM service and additional cable outlets.

The Commission also approves the licensee's request to distribute, at its option, CIVT-TV (CTV) Vancouver as part of its basic service in Kelowna, and to distribute, at its option, KVOS-TV (IND) Bellingham and KSTW (IND) Tacoma/Seattle, Washington, as part of its basic service in Vancouver and Victoria.

The licensee's request that it be authorized to receive KSTW from a Canadian source that is not a licensed Canadian satellite relay distribution undertaking is also approved.

The Commission did not receive any interventions in connection with this application.

This amendment is consistent with the approach taken by the Commission in Proposal to insert certain promotional material in the local availabilities of U.S. satellite services, Decision CRTC 95-12, 18 January 1995.

The Commission reminds the licensee that the Commission is not generally prepared, at this time, to consider applications to use such availabilities for the broadcast of commercial advertising.
