Deadline to file an application for a new FM frequency

The Commission approves the application by Aboriginal Voices Radio Inc. (AVR) for an extension of the time limit to submit an application for the use of a frequency other than 100.1 MHz to operate its new radio programming undertaking in Montréal. The Commission approved AVR's application for the new service in Native FM radio station in Montréal, Broadcasting Decision CRTC 2003-195, 2 July 2003 (Decision 2003-195), but directed the applicant to submit an amendment to the proposed technical parameters predicated on the use of another frequency.

This is the applicant's fifth request for an extension of the time limit to submit an application for the use of an alternate frequency.

The Commission grants the applicant an extension to 2 January 2006 to file an application proposing the use of another frequency that is acceptable to both the Commission and the Department of Industry.

The Commission puts AVR on notice that, if it were to file another application requesting an extension of the time limit to commence operation of this proposed station, it must also submit a detailed report providing information on its progress with respect to the implementation of the new station and on the development of programming to be broadcast on the station. Any such report should clearly illustrate that the implementation of the station will be imminent.

The Commission also puts AVR on notice that failure to commence operation of the station authorized in Decision 2003-195 within a reasonable period of time will cause the authority granted in that decision to become null and void.

The licence for this undertaking will be issued once the applicant has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 2 January 2006, as stipulated in Deadline to commence operations, Broadcasting Decision CRTC 2005-212, 24 May 2005, unless a request for an extension of time for either implementation or to find a new frequency is approved by the Commission before that date. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before that date.
