CITS-DT Hamilton - Technical change

  The Commission approves the application by Crossroads Television System to operate its transitional digital television programming undertaking CITS-DT Hamilton at channel 35VU with an average effective radiated power of 5,000 watts.
 

The application

1. The Commission received an application by Crossroads Television System (Crossroads) to operate its transitional digital television programming undertaking CITS-DT Hamilton at channel 35VU with an average effective radiated power (ERP) of 5,000 watts.
 

Background

2. Crossroads filed this application in response to the Commission's direction in CITS-TV Hamilton - transitional digital television licence, Broadcasting Decision CRTC 2004-63, 30 January 2004 (Decision 2004-63). The applicant had originally proposed to operate the digital undertaking at channel 21VU with an average ERP of 5,000 watts. However, the Canadian Broadcasting Corporation (CBC) filed an intervention opposing Crossroad's proposal because its use of channel 21VU in Hamilton would be technically mutually exclusive with channel 20VL in Toronto, for which the CBC had applied. Crossroads agreed to change the channel and to use channel 35 instead. Accordingly, in Decision 2004-63, the Commission directed Crossroads to file an application proposing the use of channel 35 and specifying the power to be used by the digital undertaking in Hamilton.
 

Interventions

3. The Commission received three interventions in connection with the present application: two in support and one in opposition by Mr. J. Griffiths.
4. Mr. Griffiths opposed the use of channel 35VU by CITS-DT because that channel is currently occupied by the U.S. station, WSEE-TV Erie, Pennsylvania. In Mr. Griffiths' view, Crossroads should use channel 21VU, as it had proposed to do in its original application for a digital licence.
5. The Commission did not receive a response to the opposing intervention.
 

The Commission's determination

6. In the circumstances, the Commission is satisfied that the proposed use of channel 35VU by Crossroads' transitional digital undertaking in Hamilton is in the public interest.
7. The Commission approves the application by Crossroads Television System to operate its transitional digital television programming undertaking CITS-DT Hamilton at channel 35VU with an average ERP of 5,000 watts.
8. The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department of Industry notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.
