  Further to its Broadcasting Notices of Public Hearing CRTC 2006-2 and 2006-2-1 dated 19 and 27 January 2006 and 2006-2-2 dated 10 February 2006 relating to a Public Hearing which will be held on 20 March 2006 at 9:30 a.m., at  the Convention Centre, 1000 René-Lévesque Boulevard East, Québec, Quebec, to consider the following application.

  Application by Radio Express inc. to renew the licence of the French-language commercial radio programming undertaking CKOD-FM Salaberry-de-Valleyfield, expiring 31 August 2006.
  In CKOD-FM Valleyfield - Licence renewal and issuance of a mandatory order, Broadcasting Decision CRTC 2005-49, 10 February 2005 (the Decision), the Commission noted the licensee's non-compliance with respect to the provision of logger tapes and annual reports, and the contributions to Canadian talent development.
  Also, the Commission issued a mandatory order with respect to the submission of annual reports in which it ordered the licensee to comply at all time with the requirements set out in Section 9(2) of the Radio Regulations, 1986 (the Regulations).
  It appears to the Commission that the licensee may have failed again to comply with the requirements regarding the submission of annual reports, the provision of logger tapes and contributions to Canadian talent development.
  The Commission also notes that the licensee failed to demonstrate that it met its commitment regarding the tangible benefits proposed following the change in the control of the licensee and accepted by the Commission in Letter of Authority A99-0120 dated 7 September 1999, and announced in Radio Express inc., Public Notice 1999-153,14 September 1999.
  The Commission intends to inquire into this matter at the hearing. The Commission also expects the licensee to show cause at this hearing why a new mandatory order requiring the licensee to comply with the requirement of the Regulations concerning the provision of logger tapes and annual reports and to its condition of licence regarding the contributions to Canadian talent development should not be issued.
  In addition, the Commission also expects the licensee to demonstrate at this hearing why the Commission should not suspend, revoke or refuse to renew the licence under sections 24 and 9, respectively of the Broadcasting Act.

  A true copy must be sent to the applicant and proof that this has been done must accompany the intervention sent to the Commission.
  The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.
  Before initiating service through electronic mode, please ensure that you will be able to satisfy the Commission, upon request, that service of the notification was completed.
