Customer-specific arrangement

The Commission received an application by TELUS Communications Company (TCC), dated 1 May 2006, proposing a revision to the company's Special Facilities Tariff, item 689, Customer Specific Business Service - (Alberta Only). TCC proposed to continue providing this service, a Type 1 customer-specific arrangement, following the expiry of the initial contract period.

TCC noted that the Commission had approved an initial 22-month contract period ending on 16 January 2006 in Telecom Order CRTC 2004-86, 17 March 2004 (Order 2004-86). The company submitted that it had inadvertently forgotten to file for an extension but had continued to provide this service in order not to disrupt the customer's daily operations.

TCC proposed to continue providing the service to the same customer, at the existing monthly rate, until 29 July 2008, without any one-time special facility service charge, as the customer had already paid for all installations and initial provisioning under the existing arrangement.

TCC also requested Commission ratification, pursuant to subsection 25(4) of the Telecommunications Act (the Act), to charge the existing monthly rate for service during the period from 17 January 2006 to the approved effective date of its application.

The Commission received no comments with respect to this application.

In Telecom Order CRTC 2006-109, 10 May 2006, the Commission approved, on an interim basis, TCC's application, effective 16 May 2006.

The Commission notes that, as set out in subsection 25(4) of the Act, it may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if the Commission is satisfied that the rate was charged because of an error. The Commission is satisfied that TCC inadvertently forgot to file for an extension to the contract for the service.

Accordingly, the Commission approves on a final basis the application by TCC, and ratifies the charging of the monthly rate approved in Order 2004-86 from 17 January to 16 May 2006.
