Re: Review of regulatory framework for wholesale services and definition of essential service

In Review of regulatory framework for wholesale services and definition of essential service , Telecom Public Notice CRTC 2006-14, 9 November 2006, as amended by Telecom Public Notice CRTC 2006-14-1, 15 December 2006 (Public Notice 2006-14), the Commission initiated a proceeding to consider a revised definition of essential service, and the classifications and pricing principles for essential and non-essential wholesale services made available by incumbent telephone companies, cable carriers and competitive local exchange carriers to other competitors at regulated rates.

At paragraphs 23 through 25 of Public Notice 2006-14, the Commission encouraged parties to file as much information as possible on the public record because of the unique nature of the proceeding and its potential impact on the telecommunications industry and the Canadian public.   The Commission also stated that any party who considers it necessary to assert a confidentiality claim with respect to any material must file such material in confidence with the Commission and at the same time file detailed and specific reasons to support such a claim.   The Commission also stated that parties were to address in a detailed and specific manner the terms and conditions under which it might be appropriate to provide such material, on a confidential basis, to the Competition Bureau, and to legal or other representatives for other parties that request access to such information.

On 3 January 2007 , the Commission received the attached correspondence from the Competition Bureau (the Bureau) identifying, in a non-exhaustive way, the type of information that would be required from parties in order for the Bureau to provide the Commission with fully informed submissions.

Commission staff has scheduled a round table discussion to be held 18 January 2007 in the national capital region, at which interested parties will have the opportunity to express their views with respect to providing such material, on a confidential basis, to the Competition Bureau in the Public Notice 2006-14 proceeding .   The purpose of the meeting is to allow parties to identify and address all issues with respect to the provision, on a confidential basis, of such information to the Competition Bureau at the earliest possible opportunity in this proceeding.

Staff will be issuing an organization and conduct letter with the logistical details within 5 days of this letter.
