Various cable broadcasting distribution undertakings in western Canada – Short-term licence renewals and licence amendments – Corrections

The Commission hereby corrects the English- and French-language versions of Various cable broadcasting distribution undertakings in western Canada – Short-term licence renewals and licence amendments, Broadcasting Decision CRTC 2008-234, 28 August 2008, as set out below.
 

English-language version

2.

In Appendix 10, condition of licence 3 is amended as follows (change in bold):

Given that CFCN-TV-9 Cranbrook broadcasts the same programming as the local service CFWL-TV-1 Invermere, the licensee is authorized to distribute CFCN-TV-9 in place of CFWL-TV-1. The licensee is also relieved from the requirement of section 25 of the Broadcasting Distribution Regulations that it distribute CFCN-TV-9 on an unrestricted channel. Should the quality of this signal deteriorate significantly, the licensee shall immediately undertake any necessary corrective action, including the distribution of this service on another channel.

 

French-language version

The following corrections are set out in bold:
  • Paragraph 12 (second last sentence):

La perte d'auditoire pourrait avoir une incidence sur sa capacité à remplir ses objectifs, qui sont d'offrir une programmation unique à caractère régional dans toutes les régions du pays, conformément à la décision de radiodiffusion 2005-445.

  • Appendix 1, condition of licence 3:

  • Appendix 7, condition of licence 1:

1. La titulaire est autorisée à distribuer, à son gré, au service de base, les services de programmation de CICT-TV (Global) Calgary, CFCN-TV-5 (CTV) Lethbridge et CIVT-TV (CTV) Vancouver.

  • Appendix 15, condition of licence 4:

4. La titulaire est autorisée à distribuer, à son gré, au service de base, les services de programmation de KSTW-TV (UPN) Tacoma et KVOS-TV (IND) Bellingham (Washington).

In Appendix 10, condition of licence 3 is amended as follows (changes in bold):

In Appendix 12, the English-language version of condition of licence 6 was inadvertently inserted. In the French-language version, that condition of licence is replaced by the following:

6. La titulaire est autorisée à distribuer à son gré, à son volet numérique, le service de programmation sonore de toute entreprise autorisée de radio par satellite par abonnement. La distribution des signaux de radio par satellite par abonnement est assujettie aux dispositions suivantes :

(i) Aux fins de satisfaire à l'obligation de la prépondérance énoncée à l'article 6(2) du Règlement sur la distribution de radiodiffusion (le Règlement), et sous réserve de l'exception mentionnée à l'alinéa (ii) ci-dessous, la titulaire ne peut pas tenir compte des signaux des entreprises de programmation de radio traditionnelle, à moins que l'abonné ne reçoive déjà au moins 40 canaux d'une ou de plusieurs entreprises autorisées de programmation sonore payante.

(ii) Aux fins de satisfaire à l'obligation de la prépondérance énoncée à l'article 6(2) du Règlement, la titulaire peut tenir compte des signaux des entreprises de programmation de radio traditionnelle dont la distribution est rendue obligatoire par l'article 22 du Règlement.

(iii) Les canaux produits au Canada offerts par l'entreprise de radio par satellite par abonnement sont considérés comme des « services de programmation canadiens » aux fins de l'article 6(2) du Règlement.

In certain cases, the condition of licence that relieves the licensee from section 7 of the Broadcasting Distribution Regulations contained the phrase "Le doublet de service de programmation qui suit peut partager un canal." This phrase shall now read "Les deux services de programmation suivants peuvent partager un canal." This change applies to condition of licence 1 in Appendices 2, 5, 14, 17, 23, 24 and 27.

The condition of licence relating to the authorization to distribute, at its option, a special programming service consisting of ethnic and multicultural programs contained the following sentence: "La titulaire ne distribuera à ce service de programmation spéciale à caractère ethnique aucun message publicitaire autre qu'une mention d'un commanditaire ne comprenant que le logo, le nom, l'adresse, le numéro de téléphone et le genre d'activités ou de profession du commanditaire." The phrase "à caractère ethnique" in that sentence has been deleted. This change applies to condition of licence 2 in Appendix 28; condition of licence 3 in Appendices 2, 5, 14, 23, 24 and 27; and condition of licence 4 in Appendix 17.

The first sentence of condition of licence 2 in Appendices 2, 5, 14 and 15 shall now read as follows (change in bold):

La titulaire est relevée de l'exigence de l'article 25 du Règlement sur la distribution de radiodiffusion en ce qui a trait à la distribution du signal de CHEK-TV Victoria sur un canal à usage illimité.

Various conditions of licence contained the phrase "les services de programmation," although only one station is mentioned. In all of these cases, the phrase shall now read "le service de programmation." This change applies to condition of licence 1 in Appendices 6, 32, 39 and 40; condition of licence 2 in Appendix 25; condition of licence 3 in Appendices 7, 11, 12 and 19; condition of licence 4 in Appendices 8 and 19; and condition of licence 5 in Appendices 10 and 32.

Finally, in Appendices 14, 16 and 41, the condition of licence relating to the distribution of a second set of U.S. 4+1 signals1 inadvertently included a reference to distant Canadian signals. In those cases, the second paragraph of that condition of licence shall now read as follows:

La distribution d'une seconde série de signaux américains 4+1 à titre facultatif au service numérique de la titulaire est assujettie à la clause prévoyant que la titulaire respecte les règles relatives à la suppression d'émissions non simultanées énoncées à l'article 43 du Règlement sur la distribution de radiodiffusion. Le Conseil peut suspendre l'application de cette disposition pour les signaux à être distribués s'il approuve une entente signée entre la titulaire et les radiodiffuseurs. L'entente doit porter sur la protection des droits d'émissions advenant la distribution, à titre facultatif, d'une deuxième série de signaux américains 4+1 uniquement au service numérique de la titulaire.
