Follow-up to Andy Shadrack, Director, Area D, Regional District of Central Kootenay - Application to review and vary certain determinations in Telecom Decision 2007-50, Telecom Decision 2008-5

  In this Decision, the Commission approves the request to exclude five communities in the Duncan Lake area of British Columbia from the TELUS Communications Company broadband expansion proposal.

In Telecom Decision 2008-5, the Commission approved the application of Andy Shadrack, Director, Area D, Regional District of Central Kootenay (Mr. Shadrack) to review and vary Telecom Decision 2007-50. As a result, the Commission excluded five communities in Duncan Lake, British Columbia (i.e. Argenta, Howser, Lardeau, Marblehead, and Meadow Creek) [collectively, the five communities] from the list of uncontested communities in the Attachment to Telecom Decision 2007-50, pending further review of Mr. Shadrack's request. In order to have a full record on which to base its final decision regarding the five communities, the Commission directed Kaslo infoNet Society (KiN), the service provider, to file with the Commission and serve on all parties to the Telecom Public Notice 2006-15 proceeding the information identified in paragraph 9(a) of Telecom Public Notice 2006-15. The Commission also directed KiN to file answers to Commission interrogatories issued concurrent with Telecom Decision 2008-5.

TELUS Communications Company (TCC) filed comments regarding KiN's submission. The public record of this proceeding is available on the Commission's website at www.crtc.gc.ca under "Public Proceedings."

The Commission notes that KiN provided the requested responses to the Commission interrogatories, including the information identified in paragraph 9(a) of Telecom Public Notice 2006-15. In its submission, KiN confirmed that it currently provides wireless broadband services to the five communities.

The Commission also notes TCC's acknowledgement that high-speed Internet service is already available from KiN in the five communities, and TCC's willingness to remove the five communities from its broadband expansion proposal.

In light of the above, the Commission approves the request to exclude the five communities from TCC's broadband expansion proposal.
