Re:   Bell Canada 's response to Primus re: Application requesting certain orders directing Bell Canada to cease and desist from "throttling" its wholesale ADSL Access Services

The Commission is in receipt of an application, dated 3 April 2008, made by the Canadian Association of Internet Providers (CAIP) requesting that the Commission issue certain orders directing Bell Canada to cease and desist from "throttling" wholesale ADSL services and in particular, the wholesale service known as Gateway Access Service (GAS).   As part of its application, CAIP made a request for interim relief on an expedited basis.

In a Commission staff letter dated 8 April 2008, process was set out with respect to CAIP's request for interim relief.   Bell Canada provided its response with respect to CAIP's request on 15 April 2008 .   On the same day, Primus Telecommunications Canada Inc. (Primus) provided a submission in support of CAIP's request for interim relief.

The Commission is in receipt of a letter from Bell Canada dated 17 April 2008, submitting that Primus' letter is out of process and should not form part of the record for CAIP's request for interim relief.

Given the circumstances of the case, it is considered appropriate to include Primus' submission in the record.   Bell Canada can file any supplementary answer with respect to CAIP's request for interim relief by 22 April 2008, serving a copy on CAIP and Primus.   CAIP is to file its reply with respect to its request for interim relief no later than 24 April 2008 , serving a copy on Bell Canada and Primus.

Documents to be filed and served in accordance with the above process must be received, not merely sent, by the dates indicated.
