Bell Aliant Regional Communications, Limited Partnership and Bell Canada

Centrex III Service

The Commission received applications by Bell Aliant Regional Communications, Limited Partnership and Bell Canada (collectively, Bell Canada et al.), dated 13 February 2008, proposing revisions to their respective General Tariff, item 675 - Rates and Charges. Specifically, Bell Canada et al. proposed to introduce rate ranges to the following Centrex III Service rate elements related to both the monthly rates and the associated service charges: items 675.1 (b) - Voice Locals, (e) - Centrex ISDN PRI Access Arrangements, (f) - Optional System Features, and (h) - Bell Aliant Aggregation, and Bell Canada Aggregation; item 675.2 - Integrated Centrex III Service; and item 675.5 - National Centrex Service.

The Commission approved Bell Canada et al.'s application on an interim basis in Telecom Order 2008-60.

The Commission received comments from MTS Allstream Inc. (MTS Allstream) and reply comments from Bell Canada et al. The public record of this proceeding is available on the Commission's website at www.crtc.gc.ca under "Public Proceedings."

MTS Allstream indicated that it had filed an application dated 27 February 2008 with the Commission to stay and review and vary Telecom Decision 2008-10. In that Decision, the Commission determined that it would forbear from regulating Centrex services and Enhanced Exchange Wide Dial (EEWD) as they form part of the same relevant market as business local exchange services. MTS Allstream submitted that, as a result, neither interim nor final approval was appropriate for incumbent local exchange carrier tariff applications related to Centrex or EEWD services pending the outcome of its application. MTS Allstream emphasized that, in the case of such applications that had already been approved on an interim basis, the Commission should withhold final approval.

Bell Canada et al. objected to MTS Allstream's request. Bell Canada et al. submitted that these tariff filings were unrelated to forbearance and would not be affected should the Commission grant the relief sought in MTS Allstream's application. Bell Canada et al. also submitted that MTS Allstream had provided no justification for its request to suspend Bell Canada et al.'s normal tariff filings related to Centrex services and EEWD pending the outcome of MTS Allstream's application.

The Commission is of the view that as the Bell Canada et al. tariff revisions apply to non-forborne areas, they are unrelated to forbearance. The Commission therefore considers that its determination with respect to MTS Allstream's application would have no impact on these tariff filings.

In light of the above, the Commission approves on a final basis Bell Canada et al.'s applications.
