CHQI-FM Niagara-on-the-Lake – Acquisition of assets

1.

The Commission approves the application by Luciano Butera, on behalf of a corporation to be incorporated, for authority to acquire from Mrs. Jeannine Dancy the assets of the tourist radio programming undertaking CHQI-FM Niagara-on-the-Lake and for a new broadcasting licence to continue the operation of the undertaking under the same terms and conditions as those in effect under the current licence. The Commission received one opposing intervention that did not directly address the application. The intervention is available on the Commission's website at www.crtc.gc.ca under "Public Proceedings."

Mr. Butera will be the sole shareholder and director of the corporation to be incorporated.

The value of the transaction, based on the terms of the Purchase Sale Agreement, is $48,000. The Commission does not normally require benefits in transactions involving tourist information stations. Therefore, the payment of tangible benefits will not be required for CHQI-FM.

The licence for CHQI-FM will expire on 31 August 2012, the current expiry date, and will be subject to the terms and conditions set out in the appendix to this decision.

Terms and conditions of licence

 

Terms

  The licence will expire 31 August 2012.
  The Commission will issue the licence to Luciano Butera, on behalf of a corporation to be incorporated, once:
 
  • the current licence has been surrendered to the Commission; and
 
  • the applicant has satisfied the Commission, with supporting documentation, that an eligible Canadian corporation has been incorporated in accordance with the application in all material respects.
 

Conditions of licence

 

1. The licensee shall use the station solely for the purpose of providing a pre-recorded tourist information service to the Niagara-on-the-Lake area.

 

2. The licensee shall broadcast no more than six minutes of advertising material in each clock hour.

 

3. The licensee shall not broadcast musical selections, except as incidental background music.
