Various terrestrial broadcasting distribution undertakings across Canada – Licence amendments

1.      The Commission approves the application by Shaw Communications Inc. (Shaw Communications), on behalf of Shaw Cablesystems Limited (Shaw) and Videon Cablesystems Inc. (Videon) to amend the broadcasting licences for its terrestrial broadcasting distribution undertakings (BDUs) serving various locations in Alberta, Saskatchewan, Manitoba and Ontario, by extending until 30 November 2010 the authority granted by the Commission in Broadcasting Decision 2009‑488 to distribute certain high definition U.S. 4+1 signals. Shaw Communications submitted this application so that the end date of the above‑mentioned authority would coincide with the expiry date of the broadcasting licences for the above‑noted BDUs, which were administratively renewed until 30 November 2010 in Broadcasting Decision 2010‑500.[1] The Commission did not receive any interventions in connection with this application.

2.      Accordingly, for the terrestrial systems serving Fort McMurray, Edmonton (Shaw), Edmonton (Videon), Red Deer, Calgary and Lethbridge, Alberta, the condition of licence in this regard shall now read as follows (amendment in bold):

Until 30 November 2010, the licensee is authorized to distribute, on a digital discretionary basis, the signals of KIRO‑TV (CBS), KING‑TV (NBC) and KOMO‑TV (ABC) Seattle, KCPQ (FOX) Tacoma and KCTS (PBS) Seattle, Washington, as an alternative to the set of Spokane U.S. 4+1 signals authorized for distribution as part of the basic service, provided that:

3.      For the terrestrial systems serving Saskatoon, Saskatchewan; Winnipeg (Shaw) and Winnipeg (Videon), Manitoba; and Sault Ste. Marie and Thunder Bay, Ontario, the condition of licence shall now read as follows (amendment in bold):

Until 30 November 2010, the licensee is authorized to distribute, on a digital discretionary basis, the signals of KIRO‑TV (CBS), KING‑TV (NBC) and KOMO‑TV (ABC) Seattle, KCPQ (FOX) Tacoma and KCTS (PBS) Seattle, Washington, as an alternative to the set of Spokane U.S. 4+1 signals distributed on a digital discretionary basis, provided that:

4.      The Commission notes that proposed amendments to the conditions of licence set out above will be considered at the 20 September 2010 public hearing announced in Broadcasting Notice of Consultation 2010‑497.[2] As noted in Broadcasting Notice of Consultation 2010‑554, the Commission intends to review the appropriateness of these conditions of licence beyond the current expiry date of 30 November 2010 of the broadcasting licences being considered at the above‑mentioned public hearing.

[2] As noted in Broadcasting Notice of Consultation 2010‑554, the undertakings serving Thunder Bay and Sault Ste. Marie, Ontario, do not form part of the licence renewals being considered at the 20 September 2010 public hearing.
